Home office must be expressly mentioned in the employment contract. President Jair Bolsonaro, with a veto, approved Law 14,442/22, which regulates telework and changes the rules of meal allowance. Published in the Official Gazette on 09/05/2022, the norm stems from Provisional Measure (MP) 1108/22, approved and amended by the National Assembly.
The new specification defines telework (or remote work) as the provision of services outside the company's premises, predominantly or in a hybrid form, and cannot be called external work. Services provided in this way must be expressly included in the employment contract.
Regarding the meal allowance, the law establishes that it is exclusively for meals paid for in places such as restaurants or used for purchases in commerce.
